TERMS AND CONDITIONS

1. INTRODUCTION

These Terms and Conditions ("Terms") govern your access to and use of services provided by Willow Wellness Centre ("Centre," "we," "us," or "our"), located in Dorval, Quebec, Canada. By accessing our facilities, booking or attending classes, scheduling appointments, or using any of our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. SERVICES

2.1 Service Description

The Centre offers various wellness services, including but not limited to Reformer Pilates, mat Pilates, Barre, yoga, Dance Fitness, Tai Chi, meditation, personal training, holistic therapies, and related wellness services such as massage therapy, Osteotherapy, Reiki Energy Healing, Tarot and Hypnotherapy.

2.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, including hours of operation, instructors, class schedules, and treatment offerings. We will make reasonable efforts to provide advance notice of any material changes.

3. MEMBERSHIP AND PACKAGE TERMS

3.1 Membership and Package Options

Memberships and service packages are subject to the rates, terms, and conditions in effect at the time of purchase. Current pricing information is available at our front desk and on our website.

3.2 Membership and Package Changes

We reserve the right to modify membership and package structures, benefits, and pricing with 30 days' notice to existing members.

3.3 Membership/Package Duration and Renewal

• Fixed-term memberships and packages expire on the date specified at purchase.
• Auto-renewing memberships continue until canceled according to our cancellation policy.
• Class packages expire after the period specified at purchase.

3.4 Membership/Package Transfer

Memberships and service packages are non-transferable and may not be shared or resold.

3.5 Membership Freezing

Members may freeze their membership according to the following terms:

• Maximum freeze duration: 3 months per calendar year
• Minimum freeze duration: 14 days
• Freeze requests must be submitted in writing at least 7 days in advance
• Medical freezes require appropriate documentation
• Administrative fee may apply

4. BOOKING AND CANCELLATION

4.1 Booking System

Appointments and class bookings must be made through our official booking system (online, mobile app, or in person).

4.2 Cancellation Policy

• Clients must cancel at least 12 hours before the scheduled appointment or class.
• Late cancellations (less than 12 hours) or no-shows:
  • Pay-per-service clients will be charged the full service fee
  • Unlimited package holders will be charged a $10 fee

4.3 Schedule Changes

While we strive to maintain consistent schedules, we reserve the right to:

• Change instructors or practitioners
• Cancel classes or appointments due to low enrollment or unforeseen circumstances
• Modify the schedule as needed

5. PAYMENT TERMS

5.1 Payment Methods

We accept major credit cards, debit cards and cash. All payments must be made in Canadian dollars.

5.2 Pricing and Taxes

All prices are in Canadian dollars and subject to applicable federal and provincial taxes.

5.3 Price Changes

We reserve the right to modify our prices at any time. Any price changes will not affect pre-paid services or active memberships until their renewal date.

5.4 Refunds

• Services and classes are non-refundable except in circumstances outlined in our refund policy.
• Membership cancellations are subject to our cancellation policy.
• Unused prepaid classes may be eligible for credit toward future services at our discretion.

5.5 Automatic Payments

For recurring memberships, you authorize us to charge your payment method on file according to your membership agreement. You are responsible for maintaining current payment information.

6. CONDUCT AND FACILITY RULES

6.1 Code of Conduct

Clients must:

• Respect all staff, practitioners, instructors, and other clients
• Arrive on time for appointments and classes
• Maintain appropriate hygiene
• Use respectful language and behavior
• Respect the quiet and peaceful atmosphere of the Centre

6.2 Prohibited Activities

The following are strictly prohibited:

• Harassment or discrimination of any kind
• Disruptive behavior
• Unauthorized solicitation or sales activities
• Photography or recording without prior consent
• Bringing illegal substances, alcohol, or weapons onto the premises
• Smoking or vaping on the premises
• Bringing pets (except for service animals)

6.3 Facility and Equipment Use

• Equipment must be used as intended and returned to its proper place after use
• Personal belongings should be stored in designated areas
• The Centre is not responsible for lost or stolen items
• Report any damaged equipment to staff immediately

6.4 Dress Code

Appropriate athletic or comfortable attire is required for all activities. Specific requirements may apply for certain services or classes.

7. HEALTH AND SAFETY

7.1 Health Conditions

Clients must disclose relevant health conditions, including but not limited to:

• Pregnancy
• Injuries
• Medical conditions
• Allergies
• Recent surgeries

7.2 Waiver Requirement

All clients must complete and sign our liability waiver before participating in any activities or receiving services.

7.3 Right to Refuse Service

We reserve the right to refuse service to anyone if:

• We believe their health condition could be aggravated by our services
• They appear to be under the influence of alcohol or drugs
• They demonstrate inappropriate behavior
• They fail to follow our policies

7.4 Hygiene and Sanitation

Clients must adhere to all hygiene protocols, including any special requirements implemented for public health reasons.

8. DIGITAL SERVICES AND COMMUNICATIONS

8.1 Online Booking

Use of our online booking system is subject to these Terms and our Privacy Policy.

8.2 Communications

By providing your contact information, you consent to receive communications from us regarding your appointments, account, and Centre updates. You may opt out of marketing communications at any time.

8.3 Wi-Fi Use

If Wi-Fi is provided, use is at your own risk. We are not responsible for data loss, security breaches, or device damage while using our network.

9. INTELLECTUAL PROPERTY

9.1 Ownership

All content, materials, and intellectual property associated with our services are owned by the Centre or our licensors and are protected by copyright and other intellectual property laws.

9.2 Restrictions

You may not reproduce, distribute, modify, or create derivative works of our materials without our explicit written permission.

10. LIABILITY AND DISCLAIMERS

10.1 Assumption of Risk

Participation in physical activities carries inherent risks. By using our services, you voluntarily assume all risks associated with such activities.

10.2 Limitation of Liability

To the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, special, or consequential damages resulting from use of our services.

10.3 Indemnification

You agree to indemnify and hold harmless the Centre, its owners, directors, employees, and agents from any claims arising from your use of our services or violation of these Terms.

11. PRIVACY

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting. Your continued use of our services following such changes constitutes your acceptance of the revised Terms.

13. TERMINATION

13.1 Termination by Client

You may terminate your membership according to the terms of your membership agreement and our cancellation policy.

13.2 Termination by Centre

We reserve the right to terminate or restrict your access to our services, with or without notice, for violation of these Terms or for any other reason we deem appropriate.

14. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Quebec.

15. LANGUAGE

These Terms have been drafted in English and translated to French using translation tools. In case of any inconsistency between the English and French versions, the English version shall prevail to the extent of such inconsistency.

16. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Cancellation Policy, and Liability Waiver, constitute the entire agreement between you and the Centre regarding your use of our services.
